Hank Langstroth Acting Chairman, Keevin Geller, and Elizabeth McGrath were the members present. Stephen Cremer arrived at 8:00 p.m. Chairman Peg Arguimbau, and Commission Member, Christine Turnbull, were absent from the meeting. The Conservation Administrator, Greg Meister, was also present.

7:54 p.m. An Abbreviated Notice of Intent Public Hearing filed by Steve Weiss for the proposed construction of an 800+/- square foot addition on the west side of an existing single-family dwelling at
27 Livingston Road, DEP File # SE-280-0524:

David Oberlander, P.E., from BDO Engineering appeared before the Commission to represent the Applicant. The Applicant was also present.  David Oberlander submitted the green abutter cards and
a proposed plan entitled, “Conservation Commission Plan for Notice of Intent at 27 Livingston Road,
Sharon, MA.” Dated 6/4/11. He explained to the Commission that the existing house lies within the
100’ Buffer Zone of Lake Massapoag. The closest point of the existing house to the delineated wetland line is 54 feet. The proposed project will be no closer to the wetlands on the site than the existing house.
The existing single-family dwelling will remain a three bedroom house concerning the proposed project.

David Oberlander explained the following scope of the proposed project to the Commission:
  • The proposed project on the west side of existing house involves the construction of a new addition that includes a two-car garage with a master bedroom above.
  •  The Applicant proposes to raze the existing carport, deck over the carport, and the enclosed porch on the north side of the existing house, which is adjacent to Lake Massapoag. In replacement of those structures, the Applicant proposes to rebuild the existing foundation/house and install a new deck and entry way.  
  •  The Applicant has received permitting from the Board of Health for the proposed project.
  •  The Applicant previously met with the Zoning Board of Appeals seeking a special permit for a
non-conforming structure on a non-conforming lot. The Zoning Board of Appeals requested that the Applicant submit a revised plan to remove the portion of the proposed addition outside of the 30’ sideline setback requirement.
  • The architect hired by the Applicant is preparing a revised plan to meet the 30’ sideline setback requirements of the Zoning Board of Appeals and will submit a copy to the Commission.
  • The proposed garage addition is being re-designed 50 feet away from Livingston Road as opposed to 52 feet. The garage will be two feet further away from Lake Massapoag than defined on the proposed plan.
  • The proposed project involves disturbance to the existing lawn area and driveway. No further clearing of the remaining buffer zone is being proposed for the project.
Elizabeth McGrath inquired if a portion of the existing driveway along the side of Lake Massapoag would be reduced for the proposed project.   
David Oberlander replied that only a small portion of the existing driveway would be reduced where the new addition is being proposed. The square footage of the existing driveway would remain primarily the same following the construction of the proposed project.
Hank Langstroth requested that the Applicant eliminate a portion of the bituminous driveway near the carport area as part of the proposed project to improve the drainage on the proposed project site.
The Applicant expressed a willingness to comply with this request.
The Commission agreed to approve the proposed project pending the revised plan with the condition that the Applicant removes any section of the unnecessary existing bituminous driveway which previously serviced the carport.
Hank Langstroth called for a motion to close the hearing and to issue the Order of Conditions to the Applicant with the condition as discussed and pending the revised plan.
Elizabeth McGrath moved. Keevin Geller seconded. Voted. Unanimous.

8:10 p.m. Old/New Business:

The Commission’s Review of the Three-year Extension Permit Request for the Erosion Control Project at 216 N. Main Street under DEP File #SE-280-0509:

Hank Langstroth explained to the members of the Commission that the 3 year Extension Permit Request which the Commission took action on at their previous meeting does not need to be processed until next year. The Commission will address this administrative issue at a later date.

Update - Cedar Swamp Restoration Project:

The Conservation Administrator, Greg Meister, explained to the Commission that it will be necessary to
encumber approximately $6,000.00 in the Commission’s FY’11 Cedar Swamp Expense Budget for the consultants work scheduled for July. The Finance Commission has appropriated $18,000.00 in the Commission’s FY’12 Cedar Swamp Budget to continue work on the Cedar Swamp Restoration Project.
The results of the state’s initial feasibility study concerning the groundwater contours and elevation surveys of the drainage ditches within the Cedar Swamp will be completed sometime in July.

Update of the Commission’s FY’11 Legal Expense Budget:

The Conservation Administrator explained that the Legal Expense line item of the Commission’s
FY’11 Budget is depleted by approximately $4,800.00. According to the Town Accountant, no funding is available this fiscal year for a Reserve Fund Transfer due to the depleted Snow & Ice Account. A transfer of funds from the Conservation Trust Account will be necessary to replenish the Commission’s Legal FY’11 Expense Budget as most of the funds were expended to complete the Commission’s land swap with Sportsmen’s Club and for the Shaffel matter.
